Discussion B/w Justice Athar Minallah & Petitioner on PM’s Special Assistants Issue, Court Reserved its Decision

The Islamabad High Court has remarked that if the Prime Minister is not given the authority to appoint anyone as an assistant, then how will the system work.

Islamabad High Court Chief Justice Athar Minallah heard the petition seeking removal of special assistants to the Prime Minister with dual citizenship. The court reserved its decision on the admissibility of the petition.

Justice Athar Minallah remarked that where is it written in the constitution that the aides of the Prime Minister cannot have dual citizenship? When the people elect the Prime Minister, they have heavy responsibilities. What’s wrong with asking someone for help? How will the system work if they are not given enough authority to acquire help from someone?

Petitioner’s counsel Akram Chaudhry said that only five advisers could be appointed under Article 93 of the Constitution.

Justice Athar Minallah said that Article 93 deals with advisers, not special assistants, show me where it is written in the constitution that assistants cannot have dual citizenship.

The petitioner said that there is no such thing in the constitution but there is a restriction in the Rules of Business, under Rule 15.

Justice Athar Minallah said that Rule 15 has been erased in 2010.

The court reserved its decision on the admissibility of the petition.
